DMCA Policy — Cyfirow (CYFIROW LLC)

Cyfirow (CYFIROW LLC) (“Cyfirow,” “we,” “us“) respects the intellectual property rights of others and expects users of https://cyfirow.com (the “Website“) to do the same. This policy explains how copyright owners can submit notices under the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512, and how users may submit counter‑notifications.

Note: We may avail ourselves of the safe‑harbor protections of 17 U.S.C. §512. Submitting a false or bad‑faith notice or counter‑notice may lead to liability under §512(f).

2) How to file a Notice of Claimed Infringement

To submit a valid DMCA takedown notice, send a written communication to our DMCA Agent that includes all of the following (see 17 U.S.C. §512(c)(3)):

  1. Signature: a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;

  2. Work identified: identification of the copyrighted work claimed to have been infringed (or, for multiple works at a single online site, a representative list of such works);

  3. Material identified: identification of the material claimed to be infringing or to be the subject of infringing activity that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., exact URL(s));

  4. Contact details: information reasonably sufficient to permit us to contact the complaining party, such as name, physical address, telephone number, and email address;

  5. Good‑faith statement: a statement that the complaining party has a good‑faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

  6. Accuracy statement: a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Transparency: We may share your notice (including your contact information) with the user who posted the material and, in some cases, with public transparency archives.


3) What happens after we receive a notice

Upon receipt of a valid notice, we will:

  • promptly remove or disable access to the identified material;

  • notify the user who posted the material, providing a copy of the notice and instructions on how to submit a counter‑notification; and

  • take appropriate steps under our Repeat Infringer Policy (see Section 5).

If the notice is incomplete, we may request additional information before taking action.


4) Counter‑Notification (Restoration Request)

If your material was removed or disabled due to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter‑notification to our DMCA Agent that includes (17 U.S.C. §512(g)(3)):

  1. Signature: your physical or electronic signature;

  2. Identification of material: a description of the material that was removed or disabled and the location where it appeared before removal (e.g., the exact URL);

  3. Good‑faith statement: a statement under penalty of perjury that you have a good‑faith belief that the material was removed or disabled as a result of mistake or misidentification;

  4. Contact and jurisdiction: your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, that you consent to jurisdiction of any judicial district in which Cyfirow may be found, and that you will accept service of process from the person who provided the original notice or their agent.

Restoration timeline: If we receive a valid counter‑notification, we will forward it to the original complainant. We may restore the material 10–14 business days after forwarding the counter‑notification unless the complainant informs us that they have filed a court action seeking to restrain the allegedly infringing activity.


5) Repeat Infringer Policy

We maintain a policy to terminate, in appropriate circumstances, users who are determined to be repeat infringers. We also reserve the right to remove content and disable accounts for activities that we deem, in our discretion, to be infringing or in violation of our Terms & Conditions, regardless of whether there is repeat infringement.


6) Misrepresentation liability (17 U.S.C. §512(f))

Any person who knowingly and materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages (including costs and attorneys’ fees) under §512(f).


7) Modifications to this Policy

We may update this DMCA Policy from time to time. Changes will be posted on this page with a new Effective date.
